These Terms of Service (“Terms”) govern your access to and use of the SpeachTutor mobile application for iOS and related services (the “Services”) operated by us (“SpeachTutor”, “we”, “us”). By using the Services, you agree to these Terms.

1. The Services

SpeachTutor helps you analyze spoken English lessons, track vocabulary and progress, and practise with exercises. Features may include cloud sync when you create an account, AI-assisted analysis of transcripts, and optional paid subscriptions.

2. Eligibility and account

You must be able to form a binding contract in your jurisdiction. If you sign in with Apple, you are responsible for the security of your Apple ID and any activity under your account.

3. Your content

You retain ownership of audio, text, and other materials you submit (“User Content”). You grant us a worldwide, non-exclusive licence to host, process, reproduce, and display User Content solely to operate, improve, and provide the Services — including transcription, analysis, backups, and support.

You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights.

4. Acceptable use

You agree not to misuse the Services, including by: attempting to access non-public systems; interfering with other users; uploading malware; scraping or automated access contrary to our instructions; or using the Services for unlawful, harmful, or fraudulent purposes.

5. AI-generated output

Parts of the Services use machine learning and large language models. Outputs may be inaccurate or incomplete. They are for learning assistance only and are not professional, legal, medical, or educational certification advice. You remain responsible for how you use outputs.

6. Subscriptions and payments

Paid features, if offered, are billed through Apple’s In-App Purchase system. Prices, trial terms, and renewal are shown in the App and managed in your Apple ID subscription settings. To the maximum extent permitted by law, fees are non-refundable except as required by Apple or applicable law.

7. Third-party services

The Services rely on third parties (for example cloud hosting, authentication, speech recognition, and AI providers). Their availability and terms may change. We are not responsible for third-party services outside our reasonable control.

8. Intellectual property

Aside from your User Content, the App, branding, and our materials are owned by us or our licensors and are protected by intellectual property laws. No licence is granted except as expressly stated.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for claims arising from the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) fifty euros (€50), unless mandatory law provides otherwise.

11. Indemnity

You will defend and indemnify us against claims arising from your User Content or your violation of these Terms, to the extent permitted by law.

12. Termination

We may suspend or terminate access to the Services if you materially breach these Terms or if we must do so for legal or security reasons. You may stop using the Services at any time. Provisions that by nature should survive will survive termination.

13. Changes

We may modify the Services or these Terms. We will post updated Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance, where allowed by law. Material changes may require additional notice.

14. Governing law

Replace this section with the governing law and venue appropriate for your company (for example the courts of a specific country or region), or with Apple’s standard EULA where applicable for consumers.
